Asaram Bapu gets a major blow from the High Court: Life sentence to remain intact, order issued to surrender

Asaram Bapu, who is serving a sentence in Jodhpur jail for raping a minor, received no relief from the Rajasthan High Court. In a significant ruling, the division bench of the Jodhpur High Court upheld the life sentence imposed by the lower court. The court also ordered Asaram Bapu, who is currently out on parole, to surrender immediately.

The Jodhpur Division Bench has made some startling changes to this highly controversial case, examining its technical and legal nuances. While the court has removed the major stains of gang rape and conspiracy from the case, the main accused, Asaram Bapu, has received no relief from prison. His life sentence has been upheld.

Relief from gang rape, but guilty of rape

The court, hearing the appeals of three accused, including Asaram Bapu, acquitted them of gang rape (Section 376-D). The High Court clarified that the available evidence did not prove the crime of gang rape.

Big relief for co-accused, Sharad and Shilpi completely acquitted

If anyone has received the greatest relief from this High Court decision, it is the co-accused in this case, Sharad and Shilpi. The lower court had considered them complicit in the crime, but the High Court issued a significant verdict after reviewing the available evidence.

POCSO’s grip on Asaram continues

The hopes that Asaram’s supporters had raised following the release of his co-accused and the dropping of the gang rape charges were quickly dashed by the High Court. The court clarified that while the gang rape charges had been dropped, the individual charges against the main accused, Asaram, remained extremely serious and irrefutable. The court has considered the decision of conviction by the lower court under the POCSO Act and other serious sections of rape as 100% correct. The High Court said in clear words that the punishment of life imprisonment (life imprisonment) given by the lower court for the act committed against the minor victim is absolutely justified and there will be no relaxation or change in it.

Asaram ordered to go to jail immediately

The path to return for Asaram Bapu, currently out of jail on parole, is now firmly sealed. The High Court, taking a tough stance, rejected his lawyers’ arguments. The court ordered Asaram Bapu to surrender immediately and ordered his return to jail. Overall, while the removal of technical charges may have changed the nature of the case, Asaram has received no significant relief on the sentencing front, and he will now spend the rest of his life behind bars.
